Warranty Terms for Equipment Purchased from Elmark Automatyka S.A.


In the printed warranty card for a given issue/sales document, the section of the warranty conditions below is preceded by a table listing the purchased equipment along with serial numbers and assigned warranty periods.
1.
Elmark Automatyka S.A. provides a warranty for the listed items for the period specified in the table in the “Warranty” column (expressed in months), starting from the date specified in the “From date” column.
1.a.
In the case of batteries and accumulators (as separate items or as components), the warranty period is shortened and amounts to only 6 months. This provision does not apply to clearance equipment, which is covered only by a one-month start-up warranty.
1.b.
In the case of Mean Well products covered by warranty but not listed on the warranty card, the warranty period is equal to the period indicated on the datasheet for the given model provided by the manufacturer.
1.c.
The presence of one defective point (bad pixel) on the LCD screen is permitted.
1.d.
In the case of sales of Getac products outside the territory of Poland, Getac products are subject to the manufacturer’s warranty. Detailed terms and the reporting procedure are available on the manufacturer’s website at https://support.getac.com/.
2.
The warranty does not cover software; however, in the event of any identified irregularities, Elmark Automatyka S.A., by contacting the software manufacturer, makes every effort to eliminate errors.
3.
Warranty repairs are carried out within 2 weeks from the delivery of the equipment, provided that the repair is performed at the premises of Elmark Automatyka S.A.
4.
If, for technical reasons, it is necessary to send the equipment to the manufacturer, the repair is carried out within 6 weeks.
5.
Any cost of shipping the equipment to the manufacturer in such a case is borne by Elmark Automatyka S.A.
6.
The equipment should be delivered to the Elmark Automatyka S.A. service department in one of the following two ways:
 
a)
for shipments from the territory of Poland or Romania: by DHL or UPS courier service at the expense of Elmark Automatyka S.A., provided that the service request has been registered in advance at https://serwis.elmark.com.pl/,
b)
at the expense and risk of the reporting party, by any type of shipment, addressed to:

7.
The equipment should be accompanied by a detailed description of the defect and contact details of the person responsible for the equipment on the customer’s side.
8.
Transport of the repaired equipment back to the customer (after completion of the repair) is carried out at the expense of Elmark Automatyka S.A.
9.
The warranty does not cover mechanical damage or damage resulting from improper use.
10.
Elmark Automatyka S.A. also provides paid post-warranty service.
11.
The flat-rate cost of post-warranty repair of equipment purchased from Elmark Automatyka S.A. amounts to 25% of the device price according to the current price list, but not less than PLN 250 net or EUR 50.
12.
For post-warranty repairs performed, Elmark Automatyka S.A. provides a warranty for a period of 3 months from the date of performance of the service. This warranty covers only the elements/activities specified in the repair report.
13.
If the equipment sent to the service department does not include a description of the damage, and after verification it turns out to be fully operational, Elmark Automatyka S.A. reserves the right to charge a fee for equipment verification in an amount dependent on the workload, but not exceeding 25% of the value of new equipment.
14.
The liability of Elmark Automatyka S.A., as well as its suppliers, under the sales contract is limited to the value of the ordered and paid equipment, licenses, and services, and does not include lost profits, unless mandatory provisions of law provide otherwise.
 
Terms of Return of Equipment Purchased by Consumers Remotely
 
Returns are accepted without stating a reason, within 14 days from the date of delivery of the goods, in accordance with the currently applicable regulations.
 
Terms of Return of Equipment Purchased in Other Cases
 
Elmark Automatyka S.A. does not accept returns of equipment purchased by companies, except in situations where:
 
• the operation of the equipment is inconsistent with the manufacturer’s technical specification;
• the equipment specification on the order is incorrect as a result of an incorrect offer submitted by Elmark Automatyka S.A.;
• equipment inconsistent with the VAT invoice has been delivered;
• the delivery deadline was not met for reasons beyond the customer’s control;
 
In the above-mentioned, as well as all other situations where improper customer service has occurred due to the fault of Elmark Automatyka S.A. or the equipment manufacturer, returns are accepted within 2 weeks from the date of sale, without charging handling fees. The cost of transporting the returned equipment is covered by Elmark Automatyka S.A., provided that it is sent by DHL or UPS courier service.
 
In justified cases, after prior amicable agreement, Elmark Automatyka S.A. accepts returns from regular customers within a period not longer than 2 weeks from the date of sale, provided that the returned equipment is sent at the customer’s expense, charging a handling fee related to the previously incurred transport costs and the necessity of thorough, time-consuming, full verification of its technical condition. If the equipment is functional and unused, the handling fee amounts to 20% of its value according to the Elmark Automatyka S.A. price list in force on the date of sale. If the equipment is functional, but the packaging, documentation, or the equipment itself shows signs of use, the handling fee amounts to 40% of its value according to the Elmark Automatyka S.A. price list in force on the date of sale. Such equipment is discounted by Elmark Automatyka S.A. and sold via the Internet with a 40% discount. The final decision regarding acceptance of the return and the amount of the handling fee is made by an employee of Elmark Automatyka S.A. after receipt and verification of the returned equipment.
